what a crock! any chance of finding one from a wrecked truck to get you by?

Got a lawn chair and a sign? go sit in front of the dealership, if that doesent work then bring a cooler full of beer and throw beer bottles at people. that probably wont work either but it would be fun and relieve stress, until they arrested you..

The problem with small claims is the cap on it. I believe it was $3000. I had a lawyer write up several documents, citing laws, cases, etc. We had statements from the dealership mechanic, service manager, and manager of the dealership. They flat out said, we'll see you in court. So, unless you're willing to spend that much time and money (and if you are, more power to you) in going to court, I wouldn't bother.

First, you have to draw up the complaint and file it, and unless you have lots of luck, you have to file it in the defendants county...have fun with that. I couldn't get it switched to my county. Now you have to buy a plain ticket.

Second, you have to serve them. You can't do this yourself. The sheriffs office may or may not do it, it's their choice. If they don't, you have to hire somebody to do it. This is your responsibility.

Third, even if you do get a case and date set, they're going to do everything in their power to get a stay and change the date. They don't give a damn, they have time. You may not.

I gave up at this point, it was going to cost me as much to get my money back, plus all the stress and hassle. There was a good chance I would get screwed after all that was done and be out even more money. Remember, they're going to be bringing in engineers and high dollar lawyers, a case like that would be a HUGE precedence for more owners to sue. How are you going to argue?

I wish there was a good solution, but I don't think there is. If it makes you feel any better, my tranny cost me $5500. The offroad shop that was doing my sas went under and took me for about $3500 plus parts. I'm almost getting use to it by now.

Arguement: I bought my truck new and under warranty. The diff blew before the warranty expired.. Nissan is shirking their responsibility. REmember(judge) there is huge precedent for manufacturer's to HONOR their warranty claims....

exactly hillbille... it is supposed to be up to nissan to prove (not guess) that I was mis treating my truck, not for me to defend that I wasn't abusing it... it should have been fixed 3 weeks ago, no questions asked, they should have taken the diff and examined it or whatever and then tried to back-charge me...
the reason the guy gave me as to why it won't be covered was because there were "scratches" underneath my truck, so it must have been abused off road...
well, my moms got an s2000 that I got under and its got scratches too.. I guess she's probably been abusing that offroad as well... Roll Eyes

Just curious... does your truck have the "off-road" package? My dad has the NISMO package on his truck.

Dealerships really effin piss me off. They (nissan motors) show their trucks in commercials bouncing down a trail, kickin up dust, whatever... a consumer does the same, and it is considered abuse?!?!

I'd seriously fight this tooth and nail. Go to a different dealer, and see what they'll do. Hell, if anything, go to one of the dealerships that are known to fix this problem. It'd be worth the gas money for a road trip Wink

*in no way is the term "offroad" supposed to intend the use of this vehicle off road. any offroad use will void warranty, you stink.



Really though you should put a little disclaimer below the offroad sticker on your truck.

SCratches under the truck mean nothing. SCratches are no proof as to why the diff fragged itself.

The most serious things I have hit w/ my truck have all been onroad-
( besides a lincoln, a bollard, and a block wall) a box spring foundation for a mattress. GUy didn't tie his load down Mad it was rush hour and nowhere to swerve( not that I would want to-kinda risky).. That left a few scratches underneath.

DEfinately exhaust the administrative remedies spelled out in the warranty, before pursuing other legal action. I'm guessing there's mediation , or something spec'd out- should there be a dispute over warranty coverage.

exactly... and if I am only supposed to use it in snowy/icy conditions, then why is there an electric locking diff and great crawl ratio?!? They're freaking idiots...

Well, are you gathering names or waiting for someone else to do it? Get on AC, and any other forums and start asking for names and problems. Write 3 lists with those who had thiers fixed without problem, those who had to fight and finally those who had to pay out of pocket.

Sandbag, it's not the dealer refusing to fix, is the district rep.

If someone gets me a contact in Nissan corperate I will even write a letter and send it snail mail stating that I will not even be giving Nissan the oppertunity to sell me my next truck unless this quality problem and Aaron's issue is resolved.

Aaron, your a great buddy but you have to get a move on this if you want something to happen. This post will get you a lot of sympathy and some advice but you need to start making real waves if you want something to be done. I'll do what I can but all I have is the future customer card.

Dont forget there is a number in you owners manual that you can call if the manufacture does not honor the warrenty. I forgot about this until after my first one was fixed. Call that number and let them know that your lawyer will be giving them a call becouse you want to set up litigation. And far as the list goes you can put my name on both list. Those who had to pay and those who had it done under warrenty.

My bro in law had his rear diff. fixed via warranty, im sure he wouldnt mind putting his name on the list unless you are looking for front axle only owners.

oh and one more question where do you wheel locally the only places i go are sandsavilla, paulks, and do some sand bar hopping in the satilla.
