Sorry to hear you're so down on Nissan, but I can't understand why you feel you would lose:

it was under warranty when it failed, was it not?

Your mod was the same ID as the factory ID, was it not?

Nissan had a TSB covering that very problem- didn't they?

Looks like it's 3 strikes and Nissan's out.

Easy. It's documented that my temp sensor and "t" caused a restriction and high line pressure, causing the transmission to go. They have all sorts of "facts" on hand about it. Hence, my shady remark. Do you think a judge will side with Nissan with all the "proof", or some nobody filing a complaint? It's a losing proposition.

Chevyman,Judges and courts look for excuses to flog a dealer.I ran a new car dealership for 6 years and have been a licensed dealer most of my adult life. The one who wins is the one who has his ducks in a row,but you have the edge.I'd be more than glad to help you.And Nissan is a great product, don't let a bad apple dealer ruin it for you.

I think I have about 6000 miles on my 08 and have had one problem so far. I couldn't turn the key in the ignition one morning....just refused to budge. Had to get it flat towed to the dealership where they eventually replaced the entire ignition. They said they have never had a vehicle do that before. Other than that my truck has been trouble free. I think Nissan finally got the Titan right in 08 with the bigger brakes and improved rear axle.

Well, the throttle pedal potentiometer (or whatever they call it) has a glitch in it at about 3/4 throttle. It just falls flat on it's face. You have to either back off the throttle a little, or step on it more.

This is ridiculous. This thing is GONE before the warranty is up (not that it matters, they deny it half the time anyway). Complain

I know diesel rigs have had electronic throttles for years but did not know they have gone to computer controlled throttles on gas engines.

Modern Diesels don't have throttle plates at all. They only regulate the amount of fuel and the turbo (if it's a VVT).
