hi!
it started about 2 weeks ago.i offered my ´88 samurai (97hp,licensed conversion,street legal here...) on ebay,because i don´t really use it and some extra cash would be nice during the summer.last bid was 2800,-euro.i called the guy on the phone-he was quite nice and asked for my bank account to send me the money-he would pick up the car at the weekend.he also told me to have a new emission inspection and some other things,so he can immediately have a lincence for that car and use it.2 days later,the money arrived at the bank-i took some euros and did what he told me to do.on saturday,he came to pick sammy up.as i asked him,why he didn´t use a trailer,because about 500km in a sammy wouldn´t be comfortable and told him to have an eye on the engine-temperature,because i didn´t use sammy on the " autobahn"before,he got angry from one moment to another-2800,- would be too much for such a piece of crap.i also made a wrong decription of the car,because i didn´t tell him that thing has a suspension with no comfort,like one of those wild-west-coaches you see in the movies...general,it isn´t what he looked for,he said.he trold me to send back the money,got in his volvo and drove away.today,i´ve send him the left money and asked him what to do with the money,i´ve spend on his orders.he told me that would be my problem-he wants all his money back and some money for the time he spend to get here and the gas he needed for that.what should i do with this....§$%&$%".......

What is the link to your Ebay Item..

It should have included items like shipping, returns, AS-IS, buyer inspection period, a solid descriptions, etc...

Did this dip $hit even ask any questions before he bought the car? If not and you put AS-IS in the add then tuff $hit, he bought, and its his.

If he nails you with a negitive rating disptue it with ebay or other services to get rid of the rating by him.


For quick delay tactic tell him since he wants his money back that you have to dispute this with ebay now to get the item as not sold and it's going to take time to clear up his mess.

While hes waiting for you to respond I would read online at Ebay about buying and sellilng a car and what the Terms and Condidtions are. This is something he agreed two when he created his ebay account.

I'd tell the loser to go pound sand.I've sold several tousand items on ebay and people have to ask their questions before they bid,not after.Also,any little extras cost them,not you and that must be settled before they bid.My attorney has a form letter that I send deadbeats,scam artists,and other cyber-scum.It scares the f%&^$ing crap out of them.Fear is a wonderful tool.

So,bill him for the extra stuff you did and charge him for the storage.In other words,just go midieval on his ass and watch ol' Herman the German squeal like a pig.

The guy has no recourse. I would consult with Ebay on their recommended course of action. He paid up in good faith for the vehicle - Ebay disclaimers typically state that no warranties are implied, and sales are as-is.

He should have asked more questions before bidding. Not sure what the laws are around this in Germany, but you might want to start finding out.

Hey Ebay is not pefect, I love Ebay, but sometimes I get a bad deal, it's called life, move on. I just won a little item for a dollar, it weighs a couple of grams. Now the seller wants 11 bucks to ship it, that is a joke, but it is my fault and I will probly end up paying it. In your case, the buyer needs to just get the rig and live with his purchase. Last week I won a motorcycle that was advertised as great running condition. The seller contacted me to say it has something wrong and runs like crap. I told him I don't want it, and he sent me the 200 dollar down payment back right away. It's Ebay, caviet emptor is the rule, you either know the rules or you are setting yourself up for trouble.

hi,yes,you´re right-but i don´t know why i should pay for that guys mistake...so-if you were that guy-would you dare to ask me for money?because you had such a long way to go and the whole day was spend for nothing?its his own fault...i can´t help him...no one forced him to place that bit without knowing that car.i´m not angry about that-he could have said something like:i made a mistake..i´ll pay the things i asked you to do,but let me out of this deal.-everything would have been o.k....but i´m angry about the man wanting me to pay for the bulls%&§" he did...may sound funny to you,but on ebay i prefer the guys from czech republic,hungary and romania.theres no trouble with them-they come,pay cash and go away.not one bad word at all.i´m ashamed-i´m a airforce-reserve seargent,been active for 8 years,always been a bit proud of the country i served for,but i must say this country is going a wrong way...anyone just thinks about cheating each other.maybe i should leave some day.hungary isn´t bad at all...

There's something to be said for people who come from former communist countries...they seem to be more honest.Don't be discouraged,people with bad karma always get their just reward in the end.

He might not have but I sure did... $12 bucks for and Clinometer.. that's a very good deal.. Especially when they usually go for $80-$100 bucks..

here's the way I look at it. He bid and won the item.

The car is being sold As-is. The winning bid is a written contract in my opinion. If he did not want the car he should have called, told you exactly what he was looking for.

I'll say screw him. He got most of his money. That's more than what you would get here in the states.

hi!
today i made a date with the lawyer.on friday we´ll get this thing done he said.as you said-a bid on ebay is a written contract.as i wrote in the description,he should have tried the car before placing that bid.would be no problem,if he would have asked me in a normal way,but to try to get money from me for his wasted time is a bit too much.i didn´t pay him yet-i want to hear lawyers opinion first.but today he wrote me some very angry emails and phoned up my girlfriend to call her a %$§%&/,because he hasn´t received any money yet...i´m afraid there´ll be much fun with this guy...
